These Terms of Use (“Terms”) govern your access to and use of the Free Tax Returns website and worksheet (the “Service”), provided by us (“we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
The Service is an independent, educational tool that helps Australian taxpayers identify and total potential work-related and other deductions so they can consider them when preparing their own tax return. It is designed to provide general information only.
2. Not tax, accounting or financial advice
The Service does not provide personal tax, accounting, legal or financial advice, and using it does not create any adviser, agent or professional relationship between you and us. Any figures, estimates, suggestions or results are general in nature and may not be accurate or appropriate for your circumstances.
We are not affiliated with, or endorsed by, the Australian Taxation Office (ATO), myGov or any government agency. We do not lodge returns on your behalf. You are responsible for the accuracy and completeness of your own tax return. Before relying on any information, you should confirm your eligibility with the ATO or a registered tax agent.
3. Eligibility
You must be at least 18 years old and able to form a binding agreement to use the Service. The Service is intended for individuals dealing with Australian tax matters.
4. Your responsibilities
When you use the Service, you agree to:
- Provide accurate information and keep it up to date;
- Independently verify any deduction or figure before including it in a tax return, and keep the records the ATO requires;
- Use the Service only for lawful, personal purposes;
- Keep your account and sign-in details (including your mobile number and any verification codes) secure, and let us know promptly of any unauthorised use.
5. Accounts
Some features require an account. We use passwordless sign-in (for example a one-time code sent to your mobile). You are responsible for activity that occurs under your account. We may suspend or close accounts that we reasonably believe are being misused or that breach these Terms.
6. Acceptable use
You agree not to:
- Use the Service in any unlawful, misleading or fraudulent way;
- Attempt to interfere with, disrupt or gain unauthorised access to the Service or its systems;
- Scrape, harvest, copy or bulk-extract content or data except as expressly permitted;
- Submit another person’s details without their consent;
- Introduce malware or otherwise compromise the security or integrity of the Service.
7. Referral program
We may offer a referral program that lets you invite others and, where eligible, receive a reward. Any referral program is subject to additional eligibility requirements and may be changed, limited or withdrawn at any time. Rewards are made at our discretion and only where the relevant conditions are met. You must only refer people who are happy to hear from us.
8. Intellectual property
The Service, including its content, design, text and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute or create derivative works from the Service except as permitted by law or with our written permission.
9. Third-party links and services
The Service may link to third-party websites and services (for example the ATO or myGov). We do not control and are not responsible for their content, availability or practices. Accessing them is at your own risk and subject to their terms.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any figure, estimate or result is accurate, complete or suitable for your situation.
11. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any rights or guarantees you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Subject to those rights, and to the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss arising from your reliance on information provided through the Service — including any tax outcome, penalty, interest or missed deduction. Where our liability cannot be excluded but can be limited, it is limited to re-supplying the Service.
12. Privacy
Our handling of personal information is described in our Privacy policy, which forms part of these Terms.
13. Changes to the Service and these Terms
We may update, suspend or discontinue any part of the Service, and we may change these Terms from time to time. When we change these Terms, we will update the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Australia and the state or territory in which we operate, and you submit to the non-exclusive jurisdiction of the courts of that place.
